Before you begin using our services or setting up your account with Photo Repair Australia (herein referred to as “us” or “we”, “the website”), please read the following Terms and Conditions (“T&C”) carefully. These T&C govern your access to and use of the Photo Repair Australia services. This will constitute a binding agreement between you and Photo Repair Australia (the business which operates photorepair.com.au). Your access to and use of the Photo Repair Australia service (“Services”) are expressly conditioned on your compliance with these T&C. Note that any violation of these T&C may result in termination of our Services to you.
Photo Repair Australia reserves the right to change these T&C from time to time. Please refer to the webpage regularly for any changes. By continuing to access or use our Services after Photo Repair Australia makes any changes, you agree to be bound by any such revised T&C.
If you disagree with any part of these T&C, please do not use our Services.
1. Our services
Photo Repair Australia provides photo retouching services to customers. We accept orders placed directly by email and through our website contact form at www.photorepair.com.au
We are based in Australia.
If you submitted your image/images and instructions and made a payment, we’ll process your order and deliver the finished image/images to you by email, WeTransfer, Dropbox.
2. Your Submissions
By submitting images, you grant Photo Repair Australia a non-exclusive, royalty-free license to use, transmit, modify, copy, display and edit any digital files or images received through use of the website for the purposes of completing your order.
You agree that you understand copyright and trademark laws and that all images and communications submitted to Photo Repair Australia do not violate any laws.
By using our services, you agree that you will NOT upload, place or transmit any of the following materials or obtain any of the following materials using our Services:
Any content that is unlawful, pornographic, abusive, inappropriate, threatening, promoting racism or harm against any individual or a group.
Any materials containing software viruses or computer codes, programs or files, destroying, interrupting or limiting the functionality of any computer equipment and software/hardware.
Content that could infringe copyrights, rights of privacy or other intellectual property rights without the permission of the owner of these rights and the persons who are shown in the material.
3. Public Information
Your images and material submitted to the Photo Repair Australia website/email and retouched images are not accessible to public unless you share them with your networks. We never publish your images without your permission.
We respect your privacy and never outsource your projects outside of our in-house team.
However, you should know that images and information submitted to Photo Repair Australia are not confidential and may be read or intercepted by third parties. You confirm that if such interceptions occur, Photo Repair Australia is not liable in any manner under all applicable laws and jurisdictions.
Our Service may contain links to thirdparty web sites or services that are not owned or controlled by Photo Repair Australia.
Photo Repair Australia has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Photo Repair Australia shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
Original images are the copyrighted property of their respective owners.
4. Data Storage
You agree that Photo Repair Australia does not provide data storage services and has no responsibility or liability for the deletion your upload after the service was delivered.
Our prices are quoted in Australian dollars. You agree that billing and shipping information that you submit is accurate. You agree that Photo Repair Australia is not liable for any delay in services or products that result from inaccurate billing/shipping information.
You are required to make a full payment at the time of placing your order.
We accept payment by bank transfer.
For bank transfer, we require your name, address, business name; before you place an order.
6. We do not claim any copyright to finished photos submitted by our customers.
7. We may ask to use your finished photo as a Before and After comparison in our portfolio/social media.
8. Canceling the Services
Photo Repair Australia reserves the right to cancel the services/the order or to terminate business with you or to suspend using the website at any time and without recourse to the courts.
9. Photo Replacement
Photo Repair Australia does not accept photo replacement after service is delivered. If you sent us a wrong image(s) or instructions and the order was completed , you are not allowed to ask us to edit another photo for free as a replacement. You agree that you are responsible for the consequences of sending us a wrong photo/instructions.
10. No Refund policy
If you are not satisfied with our work, we offer 3 rounds of revisions within 30 days of delivery. We’ll do our best to give you the best results possible but we have a NO REFUND policy as we contribute our time.
11. Revision Policy
Photo Repair Australia provides 3 rounds of revisions of your finished photos at no charge. Revision requests are acceptable during 30 days after receiving an order. If you do not take any actions within 30 days, your order will be automatically closed and can not be re-opened. You will need to place a new order for retouching or revising the same photos.
Revision instructions should not conflict with or deviate from the original instructions filled out when the order was placed.
Photo Repair Australia makes no warranty that our services will meet all your requirements or that finished photos will meet your expectations.
12. Language of the Terms and Conditions
The parties have agreed that the Terms and Conditions and related documents shall be written in English.
